Terms & Conditions

1. Definitions

“The Photographer” refers to Captured by Jackie/Jackie Munro.

“The Client” refers to the individual(s) making the booking and all participants attending the session.

These Terms & Conditions form part of the agreement between the Photographer and the Client and apply to all bookings unless otherwise agreed in writing.

2. Booking & Payment

A non-refundable booking fee/deposit of £30.00 is required to secure the session date and time. No booking is confirmed until the deposit has been received.

The remaining balance is due prior to the delivery of your selected images/album unless otherwise agreed in writing.

Payments may be made via bank transfer or cash.

3. Cancellation & Rescheduling

If the Client cancels the booking, the booking fee/deposit is non-refundable. Rescheduling requests must be made in writing and can be arranged (when possible) by emailing capturedbyjackie@outlook.com.

The Photographer will make reasonable efforts to accommodate a new date, subject to availability.

If the Client cancels within 48 hours of the session, the Photographer reserves the right to charge the value of the lowest package available for their chosen photoshoot.

In the event of severe weather, illness, emergency, or circumstances beyond reasonable control, the Photographer may reschedule the session to a mutually agreed date.

If the Photographer is unable to perform the services due to illness, emergency, accident, or other unforeseen circumstances, liability shall be limited to a full refund of monies paid.

4. Session Conduct

The Client agrees to arrive on time for the session.

Late arrival may reduce shooting time.

The Photographer reserves the right to end the session early or refuse service if any participant behaves in a threatening, abusive, unsafe, or inappropriate manner.

The safety of children remains the responsibility of the Client or legal guardian at all times.

5. Artistic Style & Editing

The Client acknowledges that they are familiar with the Photographer’s style and portfolio. The Photographer retains full creative and artistic discretion regarding:

poses,
locations,
composition,
lighting,
editing style,
and image selection.

Final delivered images are selected and edited at the Photographer’s discretion.

RAW or unedited files will not be supplied.

Additional editing requests may incur extra charges.

6. Delivery of Images

Final edited images will be delivered within approximately 2 weeks of the session. Images will typically be supplied via online gallery download unless otherwise agreed.

The Photographer is not responsible for delays caused by circumstances beyond reasonable control.

The Client is responsible for downloading and backing up all digital files upon delivery.

Online galleries may remain active for a limited period of 2 weeks for you to select your chosen images, unless specified otherwise.

7. Copyright & Usage

The Photographer retains full copyright and ownership of all images created during the session in accordance with the Copyright, Designs and Patents Act 1988.

The Client is granted a personal-use licence for the delivered images. The Client may:

print images for personal use,
share images online for personal, non-commercial purposes,
and store copies for personal use.

The Client may not:

sell images,
alter images significantly,
apply filters or heavy edits,
submit images to competitions,
or use images commercially without written permission.

The Photographer requests that credit/tagging be provided when images are shared online where possible.

8. Social Media & Image Alteration

The Client agrees not to edit, crop excessively, apply filters, or otherwise alter delivered images in a manner that changes the Photographer’s artistic work.

Images shared online should remain as delivered.

9. Model Release

Unless the Client opts out in writing before the session, the Client grants the Photographer permission to use images from the session for:

portfolio display,
website content,
social media,
studio samples,
competitions,
advertising,
publications,
and promotional purposes.

The Client confirms that they are the parent or legal guardian of any minors participating in the session and consent to their appearance in photographs.

The Client may request privacy/no-publication in writing prior to the session.

10. Client Cooperation

The Photographer is not responsible for missed images due to:

lack of cooperation,
late arrival,
children refusing participation,
weather conditions,
venue restrictions,
or interference from guests or third parties.

The Client agrees to communicate any important shot requests before the session.

11. Archiving

The Photographer may archive images for up to 12 months after delivery but is not required to retain files indefinitely.

The Photographer strongly recommends the Client create multiple backups upon receipt.

12. Limitation of Liability

While every reasonable effort is made to provide high-quality services and safeguard images, the Photographer’s liability for any claim, loss, or damage shall be limited to the total amount paid by the Client.

The Photographer shall not be liable for:

indirect or consequential loss,
technological failures,
corrupted files,
equipment malfunction,
or circumstances beyond reasonable control.

13. Force Majeure

Neither party shall be liable for failure to perform obligations where such failure results from events beyond reasonable control, including but not limited to:

severe weather,
illness,
government restrictions,
natural disasters,
transportation disruption,
or emergencies.

14. Data Protection & Privacy

The Photographer will process personal data in accordance with applicable UK GDPR and data protection legislation.

Client information will not be sold or shared with third parties except where necessary to fulfil contracted services.

15. Acceptance

Payment of the booking fee and/or attendance at the photography session constitutes acceptance of these Terms & Conditions.
